    Welcome to Metefy.com ("Metefy," "we," "us," or "our"), a peer-to-peer lost and found platform accessible at www.metefy.com (the "Platform"). These Terms and Conditions ("Terms") govern your access to and use of the Platform, including all features, services, and content provided therein. By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use the Platform.

    1. Acceptance of Terms

    By creating an account, accessing, or using the Platform, you confirm that:

    • You are at least 18 years old (or 16 in the EEA, where applicable, subject to parental consent if required).
    • You have the legal capacity to enter into a binding agreement.
    • You agree to comply with these Terms and all applicable laws and regulations.
    • You have read and understood our Privacy Policy, which governs how we collect, use, and protect your personal data.

    If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

    2. Platform Overview

    Metefy is a peer-to-peer lost and found platform that allows users to:

    • Create an account using Google Authentication.
    • Build a public profile with information such as name, X username, metro card number, bio, Metefy token number, and Google profile picture.
    • Link metro card numbers or Metefy token numbers to their profile for identification.
    • Search for users by metro card number or Metefy token number to view their public profile and contact them.
    • Communicate with other users via a messaging feature to facilitate the return of lost items.
    • Request account or data deletion by emailing amit.enthusiast@gmail.com.

    The Platform is intended to connect individuals who have lost items (e.g., metro cards) with those who have found them. Metefy does not guarantee the recovery of lost items or the accuracy of user-provided information.

    3. Account Creation and Management

    a. Account Creation

    To use the Platform's full features, you must create an account using Google Authentication. You agree to provide accurate and complete information during signup.

    You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

    You must notify us immediately at amit.enthusiast@gmail.com if you suspect unauthorized access to your account.

    b. Profile Information

    You may provide public profile information (name, X username, metro card number, bio, Metefy token number) and private information (mobile phone number). Public profile information, including your Google profile picture, will be visible to anyone searching for your metro card number or Metefy token number.

    You are solely responsible for the accuracy and appropriateness of the information you provide. You must not include false, misleading, or offensive content in your profile.

    c. Account Deletion

    You may request deletion of your account or personal data by emailing amit.enthusiast@gmail.com. We will process your request in accordance with our Privacy Policy and applicable laws.

    Upon deletion, public profile information may remain visible if it was shared before your request, unless you specifically request its removal, subject to technical feasibility.

    4. User Responsibilities

    As a user of the Platform, you agree to:

    • Use the Platform only for lawful purposes, such as recovering lost items or assisting others in doing so.
    • Provide accurate and truthful information in your profile and communications.
    • Respect the privacy and rights of other users, including refraining from sharing their private information (e.g., mobile phone numbers) without consent.
    • Use the messaging feature responsibly and avoid sending abusive, harassing, or inappropriate content.
    • Comply with all applicable local, national, and international laws, including data protection laws (e.g., DPDP Act, GDPR, CCPA).

    You agree not to:

    • Create multiple accounts or impersonate another person.
    • Use the Platform to engage in fraudulent, illegal, or harmful activities.
    • Post or share content that is defamatory, obscene, discriminatory, or violates intellectual property rights.
    • Attempt to access, modify, or disrupt the Platform's systems, servers, or data through hacking, malware, or other unauthorized means.
    • Use automated tools (e.g., bots, scrapers) to access or extract data from the Platform without our prior written consent.

    5. Messaging Feature

    The Platform provides a messaging feature to allow users to communicate based on metro card numbers or Metefy token numbers. You acknowledge and agree that:

    • Your Google profile picture and message content will be visible to the recipient.
    • We do not monitor or moderate messages in real-time but reserve the right to review, remove, or suspend access to messages that violate these Terms or applicable laws.
    • You are responsible for the content of your messages and any consequences arising from them.
    • Metefy is not liable for disputes, losses, or damages resulting from user communications.

    6. Intellectual Property

    a. Metefy's Intellectual Property

    All content, features, and functionalities of the Platform, including but not limited to text, logos, designs, software, and databases, are owned by Metefy or its licensors and are protected by Indian and international copyright, trademark, and other intellectual property laws.

    You may not reproduce, distribute, modify, or create derivative works of the Platform's content without our prior written consent.

    b. User Content

    By providing content to the Platform (e.g., profile information, messages), you grant Metefy a worldwide, non-exclusive, royalty-free, transferable license to use, store, display, and reproduce that content solely for the purpose of operating and promoting the Platform (e.g., displaying your public profile in search results).

    You represent that you own or have the necessary rights to share any content you provide and that it does not infringe on the rights of third parties.

    7. Privacy and Data Protection

    Your use of the Platform is subject to our Privacy Policy, which details how we collect, use, disclose, and protect your personal data. Key points include:

    • Your email address and mobile phone number are kept confidential and not shared with other users.
    • Your public profile information (name, X username, metro card number, bio, Metefy token number, and Google profile picture) is visible to anyone searching for your metro card number or Metefy token number.
    • You may request deletion of your account or data by emailing amit.enthusiast@gmail.com.

    We comply with the DPDP Act for Indian users, GDPR for EEA users, CCPA for California residents, and other applicable data protection laws for international users.

    8. Termination and Suspension

    We reserve the right to suspend or terminate your access to the Platform, with or without notice, if:

    • You violate these Terms or our Privacy Policy.
    • You engage in fraudulent, abusive, or illegal activities.
    • Your use of the Platform poses a security risk or disrupts its operation.
    • We are required to do so by law.

    Upon termination:

    • Your account and access to the Platform will be deactivated.
    • Public profile information may remain visible unless you request its removal, subject to technical feasibility.
    • Any provisions of these Terms that by their nature should survive termination (e.g., intellectual property, limitation of liability) will continue to apply.

    You may terminate your account at any time by requesting deletion via amit.enthusiast@gmail.com.

    9. Limitation of Liability

    To the fullest extent permitted by law:

    • The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
    • Metefy does not guarantee the accuracy, completeness, or reliability of user-provided information, the recovery of lost items, or the availability of the Platform.
    • Metefy, its affiliates, officers, directors, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the Platform, whether based on contract, tort, negligence, or otherwise.

    In jurisdictions where liability limitations are not permitted, our liability will be limited to the maximum extent allowed by law.

    10. Indemnification

    You agree to indemnify, defend, and hold harmless Metefy, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with:

    • Your use of the Platform.
    • Your violation of these Terms or applicable laws.
    • Your content, including any infringement of third-party rights.
    • Your interactions with other users, including disputes over lost or found items.

    11. Dispute Resolution and Governing Law

    a. Governing Law

    For users in India, these Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

    For international users, these Terms are governed by the laws of India, unless mandatory local laws (e.g., GDPR consumer protections in the EEA) require otherwise.

    b. Dispute Resolution

    Informal Resolution: If you have a dispute with Metefy, you agree to first contact us at amit.enthusiast@gmail.com to attempt to resolve the issue informally within 30 days.

    Arbitration for Indian Users: Any unresolved disputes arising out of or relating to these Terms or your use of the Platform will be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration will be conducted in Mumbai, India, in the English language, by a single arbitrator appointed by mutual agreement or by a court if no agreement is reached. The arbitrator's decision will be final and binding.

    Arbitration for International Users: For users outside India, disputes will be resolved by binding arbitration under the rules of the Singapore International Arbitration Centre (SIAC) in Singapore, conducted in English, unless mandatory local laws require alternative dispute resolution mechanisms (e.g., EEA consumer protections).

    Exceptions: Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction for matters involving intellectual property rights or breaches of confidentiality.

    c. Jurisdiction

    For matters not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts in Mumbai, India, unless mandatory local laws grant you the right to pursue claims in your local courts (e.g., EEA or California residents).

    12. Changes to These Terms

    We may update these Terms from time to time to reflect changes in our practices, legal requirements, or Platform functionalities. We will notify you of significant changes by posting the updated Terms on the Platform, emailing you at the address associated with your account, or providing in-app notifications. Your continued use of the Platform after 30 days of such changes constitutes your acceptance of the updated Terms. For EEA users, we will seek renewed consent if required by GDPR.

    13. Third-Party Services

    The Platform integrates third-party services, such as Google Authentication and links to X. These services are subject to their own terms and privacy policies, which you should review. Metefy is not responsible for the practices, content, or availability of third-party services.

    14. Force Majeure

    Metefy will not be liable for any failure or delay in performing its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, or technical failures.

    15. Miscellaneous

    • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Metefy regarding your use of the Platform, superseding any prior agreements.
    • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
    • Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
    • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without restriction.
    • Language: These Terms are provided in English. Translations into other languages (e.g., Hindi) may be available for convenience, but the English version prevails in case of discrepancies.
